• Usage of CrafterHosting services constitutes acceptance and agreement to CrafterHosting Terms Of Service and Acceptable Use Policy (AUP)

• All of the terms within CrafterHosting Terms Of Service are subject to change and all hosting plans are subject to the Terms Of Service and Acceptable Use Policy (AUP)

• Webpages or websites related to any form of illegal activities are strictly prohibited. If Webpages or websites related to illegal activities are placed on the customers allocated CrafterHosting web space, their account may be terminated without notice. If a request is made by law enforcement officers for any of the customer's information (IP address, Phone #, etc.) CrafterHosting reserves the right to submit this information to the authorities.

• CrafterHosting services may only be used for lawful purposes. Transmission of any material in violation of International, Federal or State regulation is prohibited. This includes but is not limited to: material legally judged to be threatening or obscene, or material protected by trade secret laws. If you are found in violation of the CrafterHosting Terms of Use. Your account will be terminated without notice and you will forfeit all of the moneys that have been paid to CrafterHosting.

• Examples of content that is not acceptable on CrafterHosting Servers: "Pirated software" and/or "Warez", "Hacker programs and/or archives", "IRC Bots", "Gambling Related"," Copyrighted Mp3's","Adult Content or/and Adult Merchandise".

Warez

• Warez Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Spam

• Spam in any shape or form is NOT permitted and is grounds for immediate account termination. This is labeled as unwanted, unsolicited communication between you and another individual. ( ex. e-mails, telephone, NET sends) There will be NO warning.

IRC and Chat Rooms

• Internet Relay Chat (IRC) traffic is not permitted on our servers in any of its many forms including, but not limited to: bots and IRC servers. Chat rooms may be allowed on per use basis, so please ask one of our support staff before setting one up. (Some cgi/perl based chat rooms over utilize the server processor.)

• Adult Content or/and Adult Merchandise

• Pornography and sex-related merchandising is prohibited on all our servers. This includes sites that may infer sexual content, or links to adult content elsewhere. CrafterHosting will be the sole arbiter in determining violations of this provision. You specifically agree to indemnify and hold CrafterHosting harmless from any claims resulting from a breach of these terms, and/or use of the service, which damages another.

 

• We make no representation and give no warranty as to the accuracy or quality of information received by any person via the Server and we shall have no liability for any loss or damage to any data stored on the Server.

• You shall effect and maintain adequate insurance cover in respect of any loss or damage to data stored on the Server. Any access to other networks connected to CrafterHosting must comply with the rules appropriate for those other networks.

• While we will use every reasonable endeavor to ensure the integrity and security of the Server, we do not guarantee that the Server will be free from unauthorized users or hackers and we shall be under no liability for non-receipt or misrouting of email or for any other failure of email.

• CrafterHosting reserves the right to spotlight any customer's website or webpage on the CrafterHosting website.

• All monthly plans must be paid for within 3 days of payment request, CrafterHosting reserves the right to deny the customer access to our services until payment is received.

• Any bill disputes or overcharges must be reported to CrafterHosting within 3 days of arrival of the invoice. If bill disputes or overcharges are not reported within 3 days of arrival of the invoice, CrafterHosting reserves the right to disregard the dispute or overcharge.

• If a refund is requested, it will first be reviewed by CrafterHosting, upon reviewing and acceptation, CrafterHosting will refund the stated amount within 5-10 business days.

• Entry into our DNS servers may take 3-5 days to complete. Unforeseen omplications may cause for longer waiting times.

• Customer support is provided free-of-charge to customers of CrafterHosting; however, customer support may be denied to any customer who violates the CrafterHosting Terms Of Service. Customer support covers just about everything provided by CrafterHosting; however, it is at CrafterHosting discretion whether or not to provide support on webpage creation, scripting languages, etc. These services can and will be available for a negotiated fee.

• CrafterHosting is not responsible for backing up any customer's data. All customers should conduct their own data backups.

• The service provided by CrafterHosting may be cancelled by the customer at any time without cause. CrafterHosting reserves the right to cancel any customer's account without notice if the customer violates any of the CrafterHosting Terms Of Service. Sites that provide illegal sexually related material and/or links to sites that provide such content may be terminated without notice or warning.

• If CrafterHosting receives any notice of unsolicited electronic e-mail coming from any customer's domain, that customer's services can and will be terminated without notice. We do not tolerate spammers

• Any sites that utilize an abnormal amount of system resources, may be permanently or temporarily shut down while CrafterHosting diagnoses the problem.

• The liability of CrafterHosting on any customer's account is limited to the amount of money that the customer has paid CrafterHosting.

• If any customer incurs legal expenses upon CrafterHosting, we reserve the right to recover these expenses from the customer.

• If any customer's activity causes legal action to be taken (i.e., suing, etc.) against CrafterHosting, the customer will pay any damages awarded against CrafterHosting, as well as all other legal fees (i.e., lawyers, etc.).

Payments, Refunds, Cancellations and Billing

• We offer a seven day money back guarantee so that you can be sure of your hosting decision. If, at any time within the seven days after your initial account setup, you feel that you are unsatisfied with CrafterHosting and it's services, you can cancel your hosting account and we will refund your money. Refunds are made via PayPal only (unless otherwise noted upon request) and may take up to 5-10 business days to complete. If for some reason your account was terminated for violating TOS (Terms of Services) no refund is given. Refunds are not given on domain registrations. On all early cancellations, refunds will be given on a prorated Monthly basis as follows: You will be charged the monthly fee according to your package.

• For example: Joe Smith has a Business yearly package and cancels after 6 months. Joe Smith will be charged $19.95 X 6 = $119.70 his refund is $85.30 the difference of $205.00 - $119.70 = $85.30. All cancellations are based on Month to Month.

• For example: Joe Smith cancels after 3 weeks on a 3 Month Basic package. Joe Smiths' refund is given for 2 months. No refund is given for the current month as refunds are on a prorated Monthly basis not Weekly basis.

• All payments must be in US Dollars. If your check is returned by the bank as unpaid for any reason, you will be liable for a "returned check" charge of UDS $50.00. Customers are billed every 30 days, 90 days, 6 months, and yearly. We also accept Checks and Money Orders sent through the Mail, but no service shall be preformed until payment is received and money has cleared our bank. We reserve the right to allow 24-72 hours setup on our servers to allow time for money to exchange and also for our Technicians to properly setup your service. Every effort will be made to provide your service as quickly as possible.

• All accounts will be billed on their anniversary date. If the transaction is declined for any reason, your account will be immediately suspended. We will attempt to recharge your Credit Card within 24 hours from the initial decline date. If for whatever reason your Credit Card is declined on the second attempt, your account will remain in the suspended mode. On the third and final attempt if your Credit Card is declined your account will be terminated and removed from our servers.

 

By allowing CrafterHosting to provide you with service you are bound by the above and agree to the TOS (Terms of Services)
